Structuring Repayment with the IRS

Non-Collectable Status:  If you do not have the extra income to pay off your tax debt and need your entire paycheck to cover all essential living expenses, you may be eligible to have your debt classified on non-collectable status.

If you qualify for non-collectable status, the IRS will suspend your payments for a period of time allowing you to get back on your feet and provide for your family.

Installment agreements: In order to work out an installment agreement, you must provide the IRS with financial statements and other financial information verifying your financial status and ability and/or inability to pay. The amount of your tax repayment and the period during which you make payments will depend upon the amount that you owe the IRS.

IRS Debt Reduction Help

The IRS does not want you to know that as a taxpayer you may be able to settle your outstanding tax liability for less than you owe.

We can help you determine whether you may be eligible for:

  • An offer in compromise
  • An IRS penalty abatement
  • penalty abatement
  • tax levy or tax lien release

Do NOT Talk to SC Department of Revenue Investigators

Our clients often tell us that they speak to investigators because they feel that they do not have anything at all to hide. If you are approached by an investigator, contact a criminal defense attorney to discuss the best way to proceed. Don’t be fooled into thinking that it is ok to talk to the investigator.  While your intentions may be good, your words can get twisted resulting in your arrest and additional charges.

Offer in Compromise

The IRS does not want you to know that as a taxpayer you may be able to settle your outstanding tax liability for less the actual amount owed. An offer in compromise is an agreement between you and the IRS. It settles a taxpayer’s legal responsibility for what is actually owed to the government. The Strom Law Firm can help you determine whether you are eligible for an offer of compromise. We will work hard to present an Offer in Compromise for a fraction of what you owe.

The IRS permits the following types of Offer in Compromise:

  • Doubt as to liability – When the debtor can prove that there is a doubt as to the tax amount that the IRS says you owe.
  • Doubt as to collectability – When the debtor can establish that it is not likely the tax amount owed will ever be paid in full.
  • Effective Tax Administration – the debtor does not argue that he or she owes the amount or that he or she cannot pay the amount; rather, this type of offer in compromise is based on the public policy argument that it would impose an economic hardship or would be unfair. This exception is typically used when someone is suffering from a disability, long term illness or when satisfaction of the debt by seizure of property would prevent the taxpayer from affording basic living expenses.

Penalty Abatement

If you owe the IRS, you can be forced to pay interest and penalties on the amount owed. Penalties can be staggering and turn an otherwise management debt into an uncontrollable situation. Penalty Abatement is a program developed by the IRS which allows you to have your tax penalty reduced or even removed. In order to be considered, you must have a good reason and be able to prove why you did not file your tax return or pay the amount that was due. If you are an innocent spouse, your relied upon the advice of a tax professional, you suffered from medical issues, or you can prove a good reason, you may be eligible for penalty abatement.
